Ownership of Website and App; Agreement of Terms and Conditions

These Terms and Conditions of Use (the “Terms and Conditions”) apply to (i) the website located at www.goosehead.com, and all associated websites linked to www.goosehead.com  by Goosehead Insurance Agency, LLC (“Goosehead”), its subsidiaries and affiliates (collectively, the “Website”); and (ii) the software applications made available by or on behalf of Goosehead for use on or through computers or mobile devices (collectively, the “App”) . The Website and App are the property of Goosehead and its licensors.  By using the Website and/or downloading, installing, or using the App, you agree to these Terms and Conditions; if you do not agree, do not use the Website or download, install, or use the App.

Goosehead reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms and Conditions, at any time. It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of the Website or App following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms and Conditions, Goosehead grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website and App.

The Website and App are offered and available to users who are 18 years of age or older and reside in the United States or any of its territories or possessions. By using the Website or App, you represent and warrant that you meet all of the foregoing eligibility requirements. Accessing the Website or App and Account Security

We reserve the right to withdraw or amend the Website or App, and any service or material we provide on the Website or App, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website or App is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website or App, or the entire Website or App, to users, including registered users.

You are responsible for:

• Making all arrangements necessary for you to have access to the Website or App.
• Ensuring that all persons who access the Website or App through your internet connection are aware of these Terms and Conditions and comply with them.

Subject to these Terms and Conditions, Goosehead hereby grants you a limited, non-exclusive, and nontransferable right to download, install, and use the App for your personal, non-commercial use on devices owned or otherwise controlled by you (each, a "Device") strictly in accordance with the App's documentation, and to use on such Device the products and services made available in or otherwise accessible through the App, strictly in accordance with these Terms and Conditions. The App may provide you with access to the Website and products and services accessible on the Website or through the App, and certain features, functionality, and content accessible on or through the App may be hosted on the Website (collectively, "Content and Services"). Your access to and use of such Content and Services are governed by these Terms and Conditions and the Privacy Policy. Your access to and use of such Content and Services may require you to register with the Website or the App, and your failure to do so may restrict you from accessing or using certain of the App's features and functionality.

Intellectual Property Rights 

The Website, App, and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Goosehead, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms and Conditions permit you to use the Website and App for your personal, non-commercial use only. You must not copy, disassemble, decode, reproduce, translate, distribute, reverse engineer, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website or App, except as follows:

• Your computer or mobile device may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser or the App for display enhancement purposes.
• You may print one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication or distribution. 
• If we provide social media features, then you may take such actions as are enabled by such features.

• Use any manual process to monitor or copy any of the material on the App, or for any other purpose not expressly authorized in these Terms and Conditions, without Goosehead's prior written consent.
• Frame, mirror, or otherwise incorporate the App or any portion of the App as part of any other mobile application, website, or service.
• Remove, disable, circumvent, or otherwise create or implement any workaround to any copy protection, rights management, or security features in or protecting the App.

You must not access or use for any commercial purposes any part of the Website, App, or any services or materials available through the Website or App.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Website or App in breach of the Terms and Conditions, your right to use the Website or App will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Website, App, or any content on the Website or App is transferred to you, and all rights not expressly granted are reserved by Goosehead. Any use of the Website or App not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws.

Trademarks 

Goosehead’s name, the terms Goosehead and Goosehead Insurance, Goosehead’s logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Goosehead or its affiliates or licensors. You must not use such marks without the prior written permission of Goosehead. All other names, logos, product and service names, designs, and slogans on the Website and App are the trademarks of their respective owners.

Prohibited Uses 

You may use the Website and App only for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the Website or App:

• In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the United States or other countries).
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
• To send, knowingly receive, upload, download, use, or re-use any material which does not comply with the Content Standards set out in these Terms and Conditions.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter”, or “spam” or any other similar solicitation.
• To impersonate or attempt to impersonate Goosehead, a Goosehead employee, another user, or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).
• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website or App, or which, as determined by us, may harm Goosehead or users of the Website or App or expose them to liability.

Additionally, you agree not to:

• Use the Website or App in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website or App, including their ability to engage in real time activities through the Website or App.
• Use any robot, spider, or other automatic device, process, or means to access the Website or App for any purpose, including monitoring or copying any of the material on the Website or App.
• Use any manual process to monitor or copy any of the material on the Website or App or for any other unauthorized purpose without our prior written consent.
• Use any device, software, or routine that interferes with the proper working of the Website or App.
• Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website or App, the server on which the Website is stored, or any server, computer, or database connected to the Website or App.
• Attack the Website or App via a denial-of-service attack or a distributed denial-of-service attack.
• Otherwise attempt to interfere with the proper working of the Website or App.

User Contributions 

The Website or App may contain an online chat option or other interactive features (collectively, “Interactive Services”) that allow users to post, submit, publish, display, or transmit to other users or other persons (hereinafter, “post”) content or materials (collectively, “User Contributions”) on or through the Website or App. All User Contributions must comply with the Content Standards set out in these Terms and Conditions.

Any User Contribution you post to the Website or App will be considered non-confidential and non-proprietary. By providing any User Contribution on the Website or App, you grant us and our affiliates and service providers, and our licensees, successors and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

You represent and warrant that:

• You own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our affiliates and service providers, and our respective licensees, successors, and assigns.
• All of your User Contributions do and will comply with these Terms and Conditions.

You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not Goosehead, have full responsibility for such content, including its legality, reliability, accuracy and appropriateness.

We are not responsible, or liable to any third party, for the content or accuracy of any User Contributions posted by you or any other user of the Website or App.

Monitoring and Enforcement; Termination 

We have the right to:

Remove or refuse to post any User Contributions for any or no reason in our sole discretion.

• Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms and Conditions, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Website or App or the public, or could create liability for Goosehead.
• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
• Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Website or App.
• Terminate or suspend your access to all or part of the Website or App for any or no reason, including without limitation, any violation of these Terms and Conditions.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Website or App. You waive and hold harmless Goosehead and its affiliates, licensees, and service providers from any claims resulting from any action taken by Goosehead, including its affiliates, licenses, and service providers, during or as a result of its investigations and from any actions taken as a consequence of investigations by either Goosehead, its affiliates, licenses, or service providers, or law enforcement authorities.

Goosehead cannot review material before it is posted on the Website or App and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

SMS (“Text”) Messages 

Goosehead uses dedicated short codes and 10-digit long codes  to send SMS messages to its clients. Communications through Goosehead’s SMS services are on an opt-in basis. Message and data rates may apply; message frequency varies per user. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Marketing Messages. Goosehead uses short code 39984 to send marketing SMS messages to its clients notifying them of insurance product updates and availability related to their insurance portfolio or coverage.

• You can get help by texting HELP to 39984. You will receive an automated response with instructions about our service and how to obtain additional information.
• You can opt out at any time by texting STOP to 39984. You will receive a reply message to confirm that you have been unsubscribed.

Servicing Messages.   Goosehead uses fully registered 10-digit long code numbers to send and receive SMS messages for client service and support.  

• You can opt out at any time by texting STOP to any message received from a 10-digit long code number.  You will receive a reply message to confirm that you have been unsubscribed.

Please note that opting out of receiving marketing and/or servicing text messages may negatively impact your use of Goosehead’s services as you will no longer receive any text messages from Goosehead. You consent to the handling of your information as described in Goosehead’s Privacy Policy . To contact Goosehead’s customer service team for additional assistance, please call 1-800-474-1377.

Consent to receive marketing text messages is not required as a condition of purchasing any goods or services. Texts may be sent using an automatic telephone dialing system.

Content Standards 

These content standards apply to any and all User Contributions and use of Interactive Services. User Contributions must in their entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Contributions must not:

• Contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
• Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
• Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.

Insurance Services and Quotes

The Website or App may, from time to time, include making services, information, and resources available to you for general informational and educational purposes.   At your specific request and direction, the Website or App may also be used for the preparation of quotes or brokering the sale of third-party insurance products to you.  If you use the Website or App to obtain such quotes and/or insurance products, you consent to Goosehead supplying your application information to insurance companies for the purpose of fulfilling your request. We are a licensed full-service property and casualty insurance agency and do not underwrite any insurance policy made available to you through the Website or App. Any insurance policy premium quotes or ranges displayed on the Website or App are non-binding. The final insurance policy premium for any policy is determined by the underwriting insurance company following your submission of the completed application. In the event of a conflict between these Terms and Conditions and the terms of any additional terms and conditions or separate agreements with any applicable third-party insurance carriers, such other terms will control. Changes to the Website or App

We may update the content on this Website or App from time to time, but its content is not necessarily complete or up-to-date. You shall promptly download and install all Updates and acknowledge and agree that the App or portions thereof may not properly operate should you fail to do so. You further agree that all Updates will be deemed part of the App and be subject to these Terms and Conditions.

All information we collect on the Website or App is subject to our Privacy Policy . By using the Website or App, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.
